Q2. this is a fictitious scenario On the completion of his agricultural degree, Mesut, a German national, was unsure about his future career so decided to travel across Europe. After visiting a few counties, he secured a job in a bar in Barcelona. there he met his partner Patrice who is from Senegal and they begin living together shortly after meeting. Last week, Mesut was offered a job working ten hours per week at an organic farm on the outskirts of Barcelona. This paid the minimum wage, there is a chance that the job will lead to more opportunities in the future. As a result he accepts the offer. Although the organic is a public bus ride away, Mesut has heard that low-wage worker are granted free bus passes by the Spanish government, so he applies for a pass. His application for the bus pass by the Spanish government is refused on the basis that he is neither a worker nor a Spanish national. a) Has the Spanish government breached EU law in their refusal to grant a free bus pass to Mesut? After a couple of years, Mesut want braoden his experience further. He is offered a research job at an organic vineyard in Italy. He and Patrice are very excited to have the chance to move to Italy. b) Does Patrice have any rights of entry and residence under EU law in Italy? In Italy, Mesut becomes a leading member of EXPIRAR, a climate change group advocating direct action against the state. The Italian authorities have informed Mesut that they plan to deport him as he is member of this group. c)Would the Italian authorities be breaching EU law if they deport Mesut using the reason that they have provided? Knowledge of primary and secondary sources of EU law as well as the decisions made by the CJEU must be applied. As this is a problem question the IRAC method (issue, rule, application, conclusion) is expected to be used.
