Discuss what federalism is and why it is important.

Federalism is the shared power between the national (federal) and state governments. The federal government has the power to declare war, coin money, and regulate trade between states, while the state government has the power to conduct elections, issue marriage and drivers’ licenses, and establish local governments. Some powers are shared by federal and state governments, such as collecting taxes, maintaining law and order, and building highways. Federalism is important as it brings some uniformity of standards to the country and promotes its development by providing the best means of experimentation; as Fine & Levin- Waldman (2016) mentioned that “the states in the federal system are laboratories of democracy” (Section 3.4).

Discuss your policy or piece of legislation that you have selected for your Final Paper and how federalism impacts it.

The legislation that I have selected is the Affordable Care Act (2010). The Affordable Care Act (ACA) is a federal initiative that deals with the reform of the American health care system to provide quality affordable health insurance for millions of uninsured Americans. Federalism has a significant impact on the ACA policy; it affects how the program administration responsibilities are divided between the federal and state governments; it influences how medical providers are paid for services and the quality of medical care patients receive. The characteristics of federalism will help shape the American health care system.

Discuss the federalism challenges that the policy you have selected is creating or facing.

The federalism challenges that the Affordable Care Act creates are tensions between the federal and state governments. The issue is the division of power between federal and state governments; for instance, how they implement the federal law regarding states’ Medicaid expansion.
