Wardriving is the act of scanning various wireless connections using hardware and software while in a moving vehicle with the intention of finding vulnerabilities to exploit. Attackers specifically look for unsecured Wi-Fi networks and record their locations on a map. With this location data, the attackers may exploit such Wi-Fi networks themselves, or share the information with third parties for others to exploit. The law in Washington state regarding wardriving is a gray area. This is because while the process of wardriving is legal, it becomes illegal if a network breach occurs. I think that the actual process of wardriving should be legal, however taking any sort of malicious action should be illegal. This is because the action of locating unsecured wireless networks isn’t actually malicious, but using the information to exploit a network is where it becomes an attack. Depending on the severity of the attack, I think there should be fines or possible imprisonment, as there have been in some larger cases (Pulkkinen, 2012).

Wardriving is completely legal here in Arizona. I was honestly surprised by this for a bunch of reasons. The first is that someone driving around my neighborhood and connecting to my WI-FI seems like this act should be completely illegal and there should be laws around stopping this. The folks who are doing this are just as bad as a malicious actor who is trying to hack into a large corporation. The scary part is that the folks who are Wardriving are mostly trying to steal one’s personal information directly from your own home or small business and that can cause a lot of headache and time to the victim. There are some ways that folks can secure their network and that is what we should be focusing on. Use a VPN at home, use a Firewall at home so that your network is closed to the outside. Yes, there are ways to get around this but it is going to take time and most folks who are Wardriving are wanting to get in and out as quickly as possible.

War driving is legal. The law surrounding war driving is considered gray, as it is legal to war drive, but it is illegal to breach the network and steal resources. I believe that ethically one is not doing anything wrong if they are looking for networks, however they are on the line of going too far. For example, if someone connects to a public network they are not doing anything wrong, but if they then try to breach that network they are committing crime. I think that war driving should be legal, but if they do connect to a private network without permission, there should be a fine. I believe this because it should not be illegal to see what networks are around, as this can be used when building a wireless network if they have devices that could interfere with the signal, but if they connect they are stealing resources.
